PERSONAL DATA PROTECTION

-On 14/12/1999 the Act 15/1999 was published in the BOE

-Its objective is: "to guarantee to protect, with regard to the processing of personal data, public freedom and the fundamental rights of natural persons.

Scope of Application

DATA RECORDED ON A PHYSICAL SUPPORT IN BOTH THE PUBLIC AND PRIVATE SECTOR.

EXCEPTIONS

Files maintained by natural people for personal or domestic activities.
Files subject to standards on the protection of classified material.
Files for the investigation of terrorism and serious forms of delinquency

Data protection principles

DATA QUALITY

Data can not be used for purposes that are incompatible with those for which it was collected.
Data should be accurate and up-to-date.
Data should be cancelled when it ceases to be necessary.
Prohibition of data collection by fraudulent, unfair or illicit means.

SPECIFICALLY PROTECTED DATA

IDEOLOGY, TRADE UNION AFFILIATION, RELIGION OR BELIEFS.

No one can be obliged to declare this, except where the person involved has given their express, written consent.
Notify the interested party of their right to not make a declaration.

RACIAL ORIGIN, HEALTH, SEXUAL ORIENTATION.
These can only be collected for reasons of general interest (by law).
Or with the express consent of the party involved.
